JOHANNESBURG — Suspended Deputy National Police Commissioner Shadrack Sibiya has admitted having sex with the 18-year-old woman at the centre of the rape charge against him, but says the encounter was consensual.
His lawyer, Estelle Kilian, read from his affidavit during his bail application at the Randburg Magistrates’ Court on Tuesday.
Sibiya faces five charges, including rape, human trafficking and sexual grooming.
In the affidavit, Sibiya said he and the woman were left alone in a hotel room before they “proceeded to have consensual intercourse”.
He also said they remained in contact afterwards and that she expressed interest in meeting again. Sibiya denies raping her and intends to plead not guilty to all five charges.
The State, however, alleges that the woman became unconscious after consuming alcohol before he allegedly raped her.
Sibiya also disputes the human trafficking allegations, giving the court his account of how he met the women and how they later travelled in separate cars to The Grand strip club in Johannesburg.
The bail application follows his earlier remand at Kgosi Mampuru II Correctional Centre, amid State concerns about a possible escape and alleged witness interference, as detailed in our earlier bail hearing report.
Legal practitioner Zola Majavu has also discussed the legal hurdles facing Sibiya’s bail.
